Description

LF-8A - ORDER CONVERTING CASE UNDER CHAPTER 7 TO CASE UNDER CHAPTER 13 (NEGATIVE NOTICE). This form is used by the United States Bankruptcy Court for the Southern District of Florida when a debtor's bankruptcy case is converted from Chapter 7 to Chapter 13 without the need for a hearing. The conversion occurs under 11 U.S.C. §706(a), and the court enters the order because the debtor properly served the motion on all required parties and no objections were raised, implying consent under local rules. The order confirms that the debtor is eligible to proceed under Chapter 13, as the case has not been previously converted under other sections of the Bankruptcy Code. Once the case is converted, the Chapter 7 trustee is required to file a final accounting and case administration report and must promptly turn over all remaining estate property to the debtor. The debtor is then responsible for filing various financial documents, including income statements and a proposed repayment plan, within 14 days. If the Chapter 7 filing fee was previously waived, the debtor must pay the Chapter 13 fee or apply to pay it in installments. The debtor must also begin making plan payments within 30 days and complete a personal financial management course before discharge. The order warns that failure to comply with these provisions may result in dismissal of the case without further notice or hearing. www.FormsWorkflow.com
