Description

MCV-102 - NOTICE OF LIMITED CIVIL CASE MANAGEMENT CONFERENCE and ORDER TO SHOW CAUSE re: FAILURE TO COMPLY (California Rules of Court, Rule 3.740 and Standing Order 2025-03). This form is used by the Superior Court of California, County of Mendocino, specifically for limited civil cases—typically collections cases under $25,000. It serves two main purposes. First, it notifies the plaintiff and all parties of a scheduled Case Management Conference (CMC), where the court will evaluate the case's progress and ensure that parties have complied with required deadlines, such as service of the summons and complaint. Second, it serves as an Order to Show Cause (OSC), compelling the plaintiff to appear and explain why they failed to comply with certain procedural rules, such as not filing proof of service or failing to request a default judgment if the defendant hasn’t responded. If these requirements are fulfilled at least 10 days before the scheduled hearing, the OSC hearing may be vacated. The form also outlines the procedural obligations for parties, such as filing a completed Case Management Statement (CM-110) at least 15 days before the CMC, meeting and conferring on key issues 30 days in advance, and appearing prepared and authorized to proceed. While limited civil cases are generally exempt from full case management rules, these requirements apply if the defendant responds. Failure to comply may result in sanctions, including dismissal of the case. www.FormsWorkflow.com
