Description

MCV-101 - NOTICE OF CIVIL CASE MANAGEMENT CONFERENCE and ORDER TO SHOW CAUSE re FAILURE TO COMPLY WITH SERVICE DEADLINES (Pursuant to Government Code Section 68600 et seq.). This form form issued by the Superior Court of California, County of Mendocino, used in civil cases to inform the parties of two important court actions. First, it notifies the plaintiff and all involved parties of the scheduled Civil Case Management Conference (CMC), where the court will assess the status of the case, ensure compliance with deadlines, discuss potential settlement, and plan the case moving forward. All parties must appear prepared, familiar with the case, and authorized to make decisions. It includes an Order to Show Cause (OSC) hearing, which is triggered if the plaintiff fails to timely file proof of service of the summons and complaint or cross-complaint. If proof of service is filed on time, the OSC hearing is vacated; otherwise, parties must appear and explain the failure to comply. This form also outlines several procedural requirements, such as meeting and conferring at least 30 days before the CMC, filing the mandatory Case Management Statement (CM-110) at least 15 days prior to the hearing, and hiring a private court reporter if a verbatim record of the hearing is desired, due to limited court resources. Non-compliance with any of these requirements may result in court-imposed sanctions, including dismissal of the case. www.FormsWorkflow.com
