Description

DC-CV-080 - COMPLAINT AND SUMMONS AGAINST TENANT HOLDING OVER (Real Property § 8-402). This form from the District Court of Maryland is used by a landlord to initiate legal proceedings against a tenant who remains in possession of rental property after the expiration or termination of their lease, without the landlord’s consent. Filed under Maryland Real Property § 8-402, the form allows the landlord to request that the court order the tenant to vacate the premises and return possession of the property. The form includes details such as the rental property's address, whether the property is properly licensed as a rental unit, the amount and frequency of rent, and the date the tenant was given written notice to vacate. It also provides space to claim monetary damages if applicable. In addition, the form requires the landlord to disclose whether any tenant is an active member of the military, pursuant to the Servicemembers Civil Relief Act (SCRA). Once filed, the court issues a summons, directing the local sheriff or constable to notify the tenant of the court hearing, either through personal service or by posting the documents on the property. If the tenant fails to appear, the court may enter judgment in favor of the landlord for possession and possibly damages. www.FormsWorkflow.com
