This form is used in the United States Bankruptcy Court for the Western District of Texas by an individual debtor or an authorized representative of a business entity to affirm the accuracy and truthfulness of the bankruptcy petition and the creditor mailing list (matrix) that are being filed electronically. By signing this declaration under penalty of perjury, the filer confirms that they have reviewed the petition and the list of creditors and that all information, including any social security or tax identification numbers provided, is true and correct. The form must be filed at the same time as the petition and creditor list; otherwise, the case may be dismissed. For individual filers with primarily consumer debts who are filing under Chapter 7, the form also includes a statement acknowledging that they understand the alternatives available under Chapters 7, 11, 12, and 13 and have knowingly chosen to proceed under Chapter 7. If the debtor is a corporation, partnership, or LLC, the authorized representative must declare that they have authority to file on the entity’s behalf.
