DECLARATION FOR ELECTRONIC FILING OF BANKRUPTCY PETITION, LISTS, STATEMENTS, AND SCHEDULES. This form is used in the United States Bankruptcy Court for the Western District of Texas. It is completed and signed by an individual debtor—or an authorized representative of a corporation, partnership, or limited liability company—who is seeking bankruptcy relief. This declaration affirms, under penalty of perjury, that the debtor has reviewed the contents of the electronically filed petition, lists, statements, and schedules, and that all information, including any social security or tax identification numbers, is true and correct. It must be filed with the court at the same time as the electronically submitted documents, and failure to do so can result in dismissal of the bankruptcy case. For individual Chapter 7 filers whose debts are primarily consumer debts, the form includes an additional acknowledgment that the debtor is aware of the various bankruptcy chapters available under Title 11 of the U.S. Code and has voluntarily chosen to proceed under Chapter 7. If the debtor is a business entity, the form includes a certification that the signer is authorized to file on its behalf.
