Description

CAO FL 3-4 - FAMILY CASE RESPONSE AND COUNTERCLAIM. This form is used in the Idaho District Court by a respondent in a family law case who wishes to respond to a petition—such as for divorce or legal separation—and assert their own claims against the petitioner when no minor children are involved. In the Response section, the respondent indicates which specific paragraphs of the original petition they fully admit, partially admit, or deny. The respondent may also request dismissal of the petition and assert any affirmative defenses allowed under Idaho court rules. The Counterclaim section allows the respondent to file their own legal claims regarding the marriage, including confirming residency, stating grounds for divorce (such as irreconcilable differences), and identifying any separate or community property, debts, and whether a name change is requested. The form requires disclosure of whether the wife is pregnant or has children born during the marriage and if the husband is or is not the father. It includes options for how property and debt should be divided between the parties, including the return or confirmation of separate property and allocation of real estate or personal property acquired during the marriage. The form must be verified under penalty of perjury and includes a Certificate of Service confirming that copies were provided to the other party. Attached Property and Debt Schedules must detail separate and community assets and debts, how those should be divided, and how any property transfer or compensation will occur. www.FormsWorkflow.com
