DECREE FOR THE APPOINTMENT OF SUCCESSOR EXECUTORS. This is a New York Surrogate’s Court form used when a previously appointed executor of an estate has died, resigned, or become unable to serve. The decree officially authorizes the appointment of successor executors named in the decedent’s will to continue administering the estate’s remaining assets. Before issuing the decree, the court confirms that jurisdiction has been obtained, all required notices have been given, and that there are still unadministered assets in the estate. It also revokes any previously issued Letters Testamentary to the former executor and typically waives the bond requirement.
