Description

LM-01 - LOSS MITIGATION REQUEST BY DEBTOR(S) AND CERTIFICATE OF SERVICE. This form is used in the United States Bankruptcy Court in the Northern District of New York. In bankruptcy cases, the court may have a Loss Mitigation Program in place to facilitate negotiations and agreements between debtors and creditors regarding the treatment of the debtor's property, particularly their principal residence. This form is used by the debtor(s) to formally request entry into the Loss Mitigation Program with respect to their property. The debtor(s) must provide identification information about the property, including its address and the name and address of the creditor involved. The form also requires the debtor(s) to indicate the type of mortgage held by the creditor, such as a first mortgage, second mortgage, or specify if it is a different type. The debtor(s) must sign the form to acknowledge their understanding of the Loss Mitigation Program and their willingness to comply with its procedures. They also confirm that participation in loss mitigation is voluntary for all parties involved, and they are not required to enter into any agreement or settlement with any other party. The form emphasizes that the debtor(s) are not required to request dismissal of their bankruptcy case as part of any resolution or settlement reached during loss mitigation. Additionally, the form includes a section for the debtor's attorney to provide contact information. This information is necessary for communication and coordination throughout the loss mitigation process. Finally, the form includes a certificate of service where the individual submitting the form declares that they have served a true and accurate copy of the loss mitigation request to the relevant parties, either through electronic filing, first-class mail, or certified mail. The certificate must be notarized. www.FormsWorkflow.com
