This form is used in the Superior Court of Arizona in Coconino County by individuals who cannot afford the costs of serving legal documents in a court case. The affidavit supports a request to either temporarily delay (defer) or permanently cancel (waive) the fees associated with serving papers through a sheriff, constable, marshal, or by publication. The applicant must indicate which type of service they are seeking relief for and provide justification. For personal service, the applicant must show that they have attempted to obtain voluntary acceptance of service or explain why such an attempt would be futile or dangerous—such as in cases involving harassment. For service by publication, the applicant must explain the steps taken to locate the other party and list any individuals contacted in the effort to do so.
