49A - JOINT PETITION FOR SIMPLIFIED DISSOLUTION OF MARRIAGE. This form is used in the Circuit Court of Will County, Illinois, by married couples who meet specific eligibility requirements and wish to dissolve their marriage without a lengthy or contested court process. It allows both spouses, without attorneys, to jointly request the court to grant a divorce on the basis of irreconcilable differences that have led to the irretrievable breakdown of the marriage. To qualify, the marriage must have lasted less than eight years, the couple must have no children together by birth or adoption and no pregnancies, neither spouse may seek spousal support, and neither spouse may own real estate. The parties must each earn less than $20,000 annually, with a combined income under $35,000, and the total value of their marital property must be less than $10,000. Both spouses must have disclosed all assets, tax returns, and agreed in writing on how to divide marital property, debts, and liabilities. The form also provides an option to restore either party’s former or maiden name.
