Confidentiality Agreement-Mediation Session {ADR-007}

ADR-007 - CONFIDENTIALITY AGREEMENT – MEDIATION SESSION. This form is used in Inyo County Superior Court (California) to protect the privacy of communications made during court-connected or private mediation proceedings. All participants—including parties, attorneys, mediators, and other attendees—agree that any oral or written communication made during mediation cannot be used in any future or pending court proceeding unless all parties, including the mediator, consent. The agreement also specifies that privileged information disclosed in mediation retains its privileged status. Parties further agree not to subpoena the mediator or any documents connected to the mediation, and mediators cannot voluntarily testify on behalf of any party. However, the agreement allows limited disclosure to the Alternative Dispute Resolution (ADR) Administrator in cases involving mediator complaints or administrative inquiries. This confidentiality protection does not apply to written settlement agreements reached in mediation if introduced for enforcement purposes.
