SUMMONS OF CONTINUING GARNISHMENT. This is a court form used in the Magistrate Court of Gwinnett County, State of Georgia, to enforce an existing money judgment through continuing garnishment. Issued under O.C.G.A. § 18-4-78, this summons directs a garnishee—such as an employer or financial institution—to withhold non-exempt money or property owed to the defendant, including wages, beginning on the date of service and continuing for up to 1,095 days. The garnishee is required to file a written answer within 45 days of service and to submit additional answers every 45 days thereafter until the judgment is satisfied, the garnishment period expires, or the relationship with the defendant ends.
