SUMMONS OF GARNISHMENT. This form issued by the Magistrate Court of Gwinnett County is used to notify a garnishee, such as an employer or financial institution, that they are required to hold funds belonging to the defendant in order to satisfy a debt owed to the plaintiff. This form is typically used when the plaintiff has obtained a judgment against the defendant and seeks to garnish money, wages, or other assets to recover the debt. Upon receiving the summons, the garnishee must immediately freeze any property or money belonging to the defendant, excluding exempt property. The garnishee is then required to file an answer with the court within 30 to 45 days, detailing what property, wages, or funds they hold on behalf of the defendant. If the garnishee fails to respond, a default judgment may be entered against them for the remaining amount due.
