AFFIDAVIT OF CONTINUING GARNISHMENT. This is a Fulton County Magistrate Court form used by a judgment creditor to initiate a continuing garnishment against a defendant’s wages or other periodic payments owed by an employer or payor. This affidavit is filed after a money judgment has been entered and is used when the garnishee is believed to be the defendant’s employer or otherwise obligated to make recurring payments to the defendant. The affiant—who may be the plaintiff, the plaintiff’s attorney, or an authorized agent—swears under oath that a valid judgment exists, states the current balance due (including principal, post-judgment interest, and other allowable amounts), and affirms that the debt remains unpaid.
