Reg. #: Case Number: Division Courtroom SUMMONS TO DISCLAIM PATERNITY To the Respondent named above this Summons serves as a notice to appear in this case. You are hereby notified that a Petition has been filed in this Court in which it is represented that the Petitioner is disclaiming that (name of party) is the biological father of the named children in the Petition. The Petition, requests that the Court enter judgment and grant such further relief as the Court deems proper, including requiring you to pay costs of this action. You may be required to pay a filing fee with your Response. The Response form (JDF 1315) can be found at www.courts.s tate.co.us You are hereby summoned to appear for a hearing in Division of the District Court or Denver Juvenile Court, at the above address, on (date), at (time), at which time an Order may be entered identifying whether the Petitioner/Respondent is/is not the biological father of the children identified in the Petition and any other orders as appropriate. Notice: Colorado Revised Statutes 24719 - 4 - 105.5, provides that upon personal service of the Petition and Summons on the Respondent, or upon waiver and acceptance of service by the Respondent, an automatic temporary injunction shall be in effect against both parties for 120 days after its effective date, unless all pa rties consent to a modification of the temporary injunction. Either party may apply to the Court to modify the length of time the temporary injunction is in effect. You are hereby advised that, pursuant to state statute 24719 - 4 - 105 .5 , C.R.S., this request for genetic tests shall not prejudice the requesting party in matters concerning allocation of parental responsibilities pursuant to 247 14 - 10 - 124(1.5), C.R.S. If genetic tests are not obtained prior to a legal establishment of paternity and submitted into evidence prior to the entry of the final order establishing paternity, the genetic tests may not be allowed into evidence at a later date. Automatic Temporary Injunction By Order of Colorado law, you and the other part y : 1. Are enjoined from molesting or d isturbing the peace of the other party; and 2. Are restrained from removing the minor child(ren) from the state without the consent of all parties or an Order of the Court modifying the injunction; and 3. Are restrained, without at least 14 days advance notific ation and the written consent of all other parties or an Order of the Court, from cancelling, modifying, terminating, or allowing to lapse for nonpayment of premiums, any policy of health insurance or life insurance that provides coverage to the minor chil d(ren) as a beneficiary of a policy. If you fail to appear at the stated time and place, the Court may enter orders as addressed in the Petition.
