100.06 Duty of Carrier to Protect Passengers--Conductor Vested With Police Powers There was in force in the State of Illinois at the time of the occurrence in question a certain statute which provided that the conductors of all railroad trains carrying passengers shall be vested with police powers while on duty on their respective trains. It is further provided in this statute that when any passenger [shall be guilty of disorderly conduct] [uses any obscene language, to the annoyance and vexation of passengers] [plays any games of cards or other games of chance for money or other valuable thing] upon any railroad train, the conductor of the train is authorized to stop the train and eject the passenger from the train, using only such force as may be necessary to accomplish the removal, and may command the assistance of the employees of the railroad company, or any of the passengers, to assist in the passenger's removal; but before ejecting the passenger the conductor shall tender to him any unused portion of the fare which he has paid. In ejecting the passenger the conductor must exercise reasonable care to put him off at a reasonably safe place.
