Description
AOC-CVM-304 - BOND TO STAY EXECUTION ON APPEAL OF SUMMARY EJECTMENT JUDGMENT. This form is used in North Carolina District Court to allow a tenant (defendant) to remain in a rental property while appealing an eviction judgment. By completing this form, the defendant agrees to pay ongoing rent to the clerk of court as it becomes due and may be required to deposit past-due rent and prorated rent amounts. Filing this bond, along with the required payments, can temporarily stop (stay) enforcement of the eviction while the appeal is pending. If the defendant fails to make required payments on time, the stay may be lifted and eviction proceedings may continue. G.S. 42-34. www.FormsWorkflow.com
