PTO/SB/142 - RESPONSE TO NOTICE OF PAYMENT DEFICIENCY AND SHOW CAUSE ORDER – OPTIONS II & III. This form is used by applicants or patentees to respond when the United States Patent and Trademark Office (USPTO) has identified a payment deficiency related to small entity fee status. This form applies only under Options II and III of the small entity version of the Notice of Payment Deficiency & Show Cause Order. It allows the applicant or patentee to notify the USPTO that small entity status is no longer appropriate for the application or patent and to correct previously underpaid fees that were made at the reduced small entity rate in error. The filer must itemize each underpaid fee, provide the date and amount previously paid, calculate the deficiency owed based on the current USPTO fee schedule, and submit payment for the total deficiency. The form also provides options for explaining whether the erroneous assertion of small entity status was made in good faith and, if applicable, offers the option to pay a penalty once assessed. Failure to complete this form properly, itemize the deficiencies, and submit full payment will result in abandonment of the application or expiration of the patent.
