Description
SUPCV-700 - ORDER – PRIMA FACIE DETERMINATION (WIC 5977). This form is used in the Superior Court of California, County of Santa Cruz, for proceedings under the CARE Act to document the court’s initial review of a petition and determine whether the petitioner has made a prima facie showing that the respondent meets the criteria outlined in Welfare and Institutions Code (WIC) section 5972. If the court finds no such showing, the petition is denied, and the case is dismissed without prejudice. If the court finds that a prima facie showing has been made, the form is used to issue further orders, such as directing the preparation of a CARE Act Report, appointing legal counsel for the respondent, identifying the petitioner, and scheduling an Initial Appearance hearing. It also sets out notification requirements for the respondent, counsel, and relevant county behavioral health agencies to ensure all parties are informed of the proceedings. Form Adopted for MANDATORY USE. www.FormsWorkflow.com
