Description
Form MC 276 - MOTION TO REMOVE CASE FROM MEDIATION. This form is used in the State of Michigan to request that a case be taken out of the court-ordered mediation process. A party can file this motion if they believe mediation is inappropriate for specific reasons, such as cases involving child abuse or neglect, domestic abuse where attorneys for both parties will not be present, situations where one or both parties cannot negotiate for themselves and lack legal representation, or if mediation would endanger the health or safety of one or both parties. The form also allows the filer to specify other reasons for removal from mediation. It includes sections to request a court hearing on the objection, provide details about the scheduled hearing, and certify that all required parties have been served with a copy of the motion. Approved, SCAO. MCR 2.410(E), MCR 3.216(D). www.FormsWorkflow.com
