Form MC 271 - WAIVER OF EXTRADITION. This form is used in the State of Michigan when a fugitive defendant voluntarily agrees to return to the demanding state without requiring formal extradition proceedings. By signing this form, the defendant waives the issuance and service of a Michigan Governor’s Warrant, the right to an attorney unless already retained, and all other procedural rights related to extradition. The judge certifies that the defendant was informed of their legal rights and that the waiver was executed freely and voluntarily. The form also directs law enforcement or the Michigan Department of Corrections to hold the defendant in custody without bail until they are transferred to the agents of the demanding state.
