Description

CR-366 - MOTION AND ORDER RE SET-ASIDE OF JUDGMENT OF FORFEITURE. This form is used in the Alaska District or Superior Court when a defendant or the person who posted bail seeks to overturn a forfeiture judgment. This motion must be filed within 30 days after the judgment was issued and is governed by Criminal Rule 41(h)(3). It allows the filer to request that the judgment be set aside if the defendant did not willfully fail to appear in court or if justice does not require enforcing the forfeiture. The form requires attaching a copy of the judgment of forfeiture, providing an affidavit explaining the circumstances, and serving copies on the prosecutor, the defendant, and the individual or company that posted or pledged the bail. The motion must be signed before a notary or court clerk.
