PERB-6110 - MMBA REPRESENTATION PETITION. This form is used to initiate a formal request under the Meyers-Milias-Brown Act (MMBA) for the recognition or certification of an employee organization as the exclusive representative of a bargaining unit of public employees in California. This petition may also be used to request severance from an existing unit. The form must be filed electronically through the ePERB portal unless local rules provide an equivalent method. The petition requires details about the public employer, the employee organization filing the petition, and the proposed bargaining unit, including job classifications to be included or excluded and the number of employees affected. It must also indicate whether a current memorandum of understanding (MOU) is in place and disclose any other organizations with known interest in representing the employees. Depending on the type of petition, proof of majority or 30% support is required and must be submitted confidentially to the Public Employment Relations Board (PERB). Once filed, a Notice of MMBA Representation Petition must be conspicuously posted at the employer’s facilities where affected employees work for a minimum of 15 workdays.
