Description

NVB 7064 - WRIT OF EXECUTION. This form issued by the United States Bankruptcy Court for the District of Nevada is used to enforce a money judgment entered against a debtor in a bankruptcy proceeding. It authorizes the United States Marshal to collect the outstanding judgment amount from the debtor by seizing and selling the debtor’s non-exempt personal or real property. The writ specifies the original amounts awarded in the judgment—such as principal, attorney fees, interest, and court costs—as well as any additional accrued interest, fees, and costs that have accumulated since the judgment was entered. It also accounts for any partial payments or satisfaction already made by the debtor, resulting in a net balance that remains due. The writ includes instructions on how to apply collected amounts, prioritize payments, and calculate ongoing interest. It also provides notice provisions for third parties who have requested to be informed of any property sale under the writ. The Marshal is commanded to act within a specific time frame (not less than 10 days and not more than 60 days) and return the writ with a report of actions taken. Importantly, the form also includes federal wage garnishment exemptions, protecting a portion of the debtor's disposable earnings from seizure. www.FormsWorkflow.com
