AOC-CVM-903 - COMPLAINT TO RECOVER MOTOR VEHICLE TO ENFORCE POSSESSORY LIEN AND TO ESTABLISH AMOUNT OF LIEN. This form is used in the North Carolina District Court – Small Claims Division by individuals or businesses who repair, service, tow, or store motor vehicles in the ordinary course of business and have a possessory lien on a vehicle. This form is filed when the lienholder has been wrongfully deprived of possession of the vehicle by the owner (the first defendant) and seeks to both recover the vehicle and enforce the lien through a potential sale. The form allows the plaintiff to identify the vehicle, specify the charges related to repairs, towing, storage, and vehicle rental, and state the total lien amount claimed. Through this complaint, the plaintiff asks the court to: (1) order the return of the vehicle, (2) validate and enforce the possessory lien by sale, and (3) instruct the North Carolina Division of Motor Vehicles to transfer the vehicle title to the purchaser after a properly noticed sale. The form also notifies the defendant that if they dispute the lien amount, they must file a statement with the court within three business days of being served. If the defendant fails to respond, the amount claimed by the plaintiff will be presumed valid.
