AOC-CVM-900 - COMPLAINT TO RECOVER MOTOR VEHICLE HELD FOR LIEN AND TO DETERMINE AMOUNT OF LIEN. This form is used in North Carolina Small Claims Court by a vehicle owner—or the person who brought the vehicle to a service provider—to challenge the amount of a claimed lien and seek the return of their motor vehicle. This form is intended for situations where a vehicle is being held by a party (the defendant) who claims a lien for services such as repairing, towing, storing, parking, or when a vehicle has been abandoned on private property. The plaintiff acknowledges that a certain amount may be owed but disputes the total amount claimed by the defendant. The form allows the plaintiff to declare the amount they agree is owed (the “undisputed amount”) and to ask the court to decide the correct lien amount. The plaintiff may request an Order for Immediate Possession of the vehicle by depositing the full amount of the claimed lien with the Clerk of Superior Court. This deposit allows the plaintiff to recover the vehicle while the court determines the proper amount owed. The form also includes a notice to the defendant, requiring them to file a statement within three business days if they disagree with the amount the plaintiff says is being claimed.
