AOC-CV-820 - REQUEST FOR PRELITIGATION MEDIATION OF FARM NUISANCE DISPUTE. This form is used to initiate mediation between parties involved in a dispute related to farm-related nuisances, before any formal lawsuit is filed. Authorized under G.S. 7A-38.3 and governed by the Rules of Mediation for Farm Nuisance Disputes, this form allows a person, entity, or agency who believes they are affected by a nuisance arising from agricultural activities to formally request a mediation session with the opposing party and a certified mediator. The requesting party must briefly describe the nature of the nuisance and any other relevant factors, and all involved parties are given 21 days from the filing date to mutually select a certified mediator. If the parties cannot agree on a mediator, the clerk will appoint one. The mediator is responsible for arranging the session, notifying parties, conducting the mediation, and reporting the results to the court. This process is intended to encourage resolution outside of court, saving time and legal expenses. If all parties agree in writing to waive mediation before it begins, no fees are incurred.
