Description

AOC-CV-120 - COMPLAINT FOR JUDICIAL AUTHORIZATION FOR UNDERAGE PERSON TO MARRY. This form is used in North Carolina by individuals who are 16 or 17 years old and seeking court approval to marry. Under G.S. 51-2.1, minors in this age range may petition the district court to obtain judicial authorization for marriage, provided that the person they intend to marry is no more than four years older than they are. The form includes personal information about the minor plaintiff and the intended spouse, including dates of birth and addresses, and requires the plaintiff to affirm that they are capable of assuming the responsibilities of marriage and that the marriage would be in their best interest. Upon filing the complaint, the Clerk of Court is mandated to appoint a guardian ad litem—an attorney who represents the minor’s best interests during the proceedings. This guardian ad litem is authorized to access any information relevant to the case, including confidential records, to help the court determine whether the proposed marriage should be authorized. www.FormsWorkflow.com
