LF-8B - ORDER CONVERTING CASE UNDER CHAPTER 7 TO CASE UNDER CHAPTER 13 (AFTER HEARING). This form is issued by the United States Bankruptcy Court for the Southern District of Florida when a debtor's bankruptcy case is converted from Chapter 7 to Chapter 13 following a court hearing. The form reflects that the debtor filed a motion under 11 U.S.C. §706(a) and that the court determined the debtor is eligible to proceed under Chapter 13, as the case had not been previously converted under other sections and the conversion is otherwise justified. Upon conversion, the Chapter 7 trustee is required to file a final accounting and report on case administration and turn over any remaining property of the estate to the debtor. The debtor, in turn, must file updated financial statements, a Chapter 13 repayment plan, and, if applicable, pay or arrange to pay the Chapter 13 filing fee. The debtor must begin making plan payments within 30 days and complete a course in personal financial management by the end of the repayment period.
