LF-12 - ORDER CONVERTING CASE UNDER CHAPTER 13 TO CASE UNDER CHAPTER 7. This form is used by the United States Bankruptcy Court for the Southern District of Florida when a debtor’s Chapter 13 bankruptcy case is converted to a Chapter 7 case. The conversion may occur either by the debtor's consent or upon a motion filed by a party in interest under 11 U.S.C. §1307(c), followed by a hearing. The order formally authorizes the conversion and outlines the debtor’s and Chapter 13 trustee’s post-conversion responsibilities. These include filing updated schedules, a list of postpetition debts, and other required financial documents; transferring estate records to the Chapter 7 trustee; and ensuring creditors are notified. The debtor must also complete and file various forms and certificates, including means testing documents and a statement of intention regarding secured property. If the conversion occurs after plan confirmation, the debtor must report any newly acquired property, unpaid debts, and new contracts.
