Description

CR-206 - ORDER OF COMMITMENT FOR TREATMENT (INCOMPETENCY). This form is used by a Wisconsin Circuit Court to order the involuntary commitment of a defendant who has been found incompetent to proceed in a criminal case but is likely to become competent with appropriate treatment. The form records the court’s findings that the defendant is either charged with or found guilty of certain crimes and currently lacks the mental capacity to participate in legal proceedings. It also documents whether the involuntary administration of medication is necessary to restore the defendant’s competency, based on professional evaluation and a treatment plan. The order suspends ongoing court proceedings, including bail and bond conditions, and commits the defendant to the Department of Health Services for treatment for a period not to exceed 12 months or the maximum sentence for the most serious offense, whichever is shorter. The form authorizes DHS to administer medication, even involuntarily if necessary, and outlines procedures for transport, record sharing, re-examinations, and reporting to the court. §971.14(5), Wisconsin Statutes. www.FormsWorkflow.com
