Summons Of Garnishment On A Financial Institution

SUMMONS OF FINANCIAL GARNISHMENT. This is a Gwinnett County Magistrate Court form used by a judgment creditor to garnish funds held by a bank or other financial institution belonging to a judgment debtor. Issued pursuant to O.C.G.A. § 18-4-76, this summons commands the garnishee to immediately hold all non-exempt money or property of the defendant in its possession, including funds in accounts or safe-deposit boxes, for the statutory garnishment period. The garnishee must file a written answer with the court not sooner than 5 days and not later than 15 days after service and remit any funds subject to garnishment with the answer. The form is not used for continuing garnishments or for continuing garnishments related to child support or alimony, which require different statutory forms.
