Description

AFFIDAVIT OF CONTINUING GARNISHMENT FOR SUPPORT. This is a Fulton County Magistrate Court form used to initiate a continuing garnishment to collect past-due support obligations, such as child support or spousal support, after a judgment has been entered. This affidavit is filed when the defendant is at least one month in arrears on a court-ordered support obligation. The affiant—who may be the plaintiff, the plaintiff’s attorney, or an authorized agent—swears under oath to the existence of the support judgment, the amount of arrearage, and the periodic support amounts owed to one or more obligees. The form also identifies the payment frequency, termination dates for support obligations, and affirms that the garnishee is an employer or payor of periodic funds to the defendant.
