MOTION FOR GARNISHMENT. This form is used in the County Court of Polk County, Florida, Civil Division, when a plaintiff who has already obtained a judgment against a defendant seeks to collect the money owed through garnishment. This motion requests that the court issue a Writ of Garnishment against a third party, called the garnishee, who may be holding property, money, or other assets belonging to the defendant. The plaintiff must show the court that the defendant does not have visible property available to satisfy the judgment and that the garnishee may have assets in their possession that can be used to pay the debt.
