Signature of Rep. Date: TERMS AND CONDITIONS 1. Purpose: This constitutes an order of photography and/or videography services between contracting party referred to as ?client? and All Digital Studios, LLC (referred to as ?Studio?) and it?s employees, contractors, and sub-contractors. It is a two-page agreement. It is understood that any samples of our work remain the property of All Digital Studios, LLC and may be used for advertising and display. i.e. This is also a model release and it?s a compliment if you end up on our wall. 2. Model Release: The contracting party grants Videographerthe unrestricted right to copyright, use and publish photos/videos of the contracting party for commercial, promotion, competition or other purposes without compensation or liability. It is the responsibility of the client to advise all participants/ attendees that the event will be videotaped and photographed. All parties attending the event will be considered as consenting to be included in the final photos/videos and/or commercial promotional materials. i.e. If your uncle is a wanted fugitive, this might be a problem. 3. Editing: All Digital Studios, LLC edits approximately 300 photographs per event. The choice of those 300 is at Studio?s discretion. Editing of the remaining photos can be done for an additional fee of $175 per 600 additional photos. i.e. This helps keep prices low. 4. Retainer/ Reservation Fee: Upon signature, All Digital Studios, LLC reserves the date agreed upon. For this reason, all retainer/ reservation fees are non-refundable, even if the wedding date is changed or cancelled for any reason. Should client not pay the balance due two weeks prior to event date, client?s retainer will be forfeited and Studio is under no further obligation to client. i.e. We save the date for you. If you call off the wedding, or go to Vegas, you don?t get your reservation fee back. Period. 5. Pre-Event Conversation: The parties agree to a pre-event conversation approximately one to two weeks before the event date in order to finalize shooting times, locations, preferences and special requests. If All Digital Studios, LLC has not contacted the client at least four days prior to the event, it is the responsibility of the client to contact Studio. Failure of client to contact All Digital Studios within four days of event makes this agreement null and void. (also, failure of client to complete a ?shot list? can diminish quality of final product). i.e. Sometimes, people are difficult to get a hold of. If we don?t call you, please call us. 6. Location: It is the responsibility of the client to secure permission of the church, synagogue or venue to videotape and/or photograph the event. Videographergive its best efforts to abide by the rules of the church/synagogue. i.e. We will move around and get the best shots possible without making the Church Lady mad. 7. Copies/originals: Videographerplans to, but is not obligated to, retain copies and masters of the photos and videos. i.e. We?ll probably keep all of your stuff for at least 3 to 5 years. 8. Final Product: All Digital Studios, LLC will make best efforts to give the client the best photos and videos possible, but makes no guarantee, in regards to the quality of the photographs which are influenced by many factors sometimes beyond our control. The Studio also reserves the right to edit and delete photos as we deem fit for the benefit of the client and we can not guarantee that everyone in the event will be photographed or included in the final edited photographs, or that any particular shot, effect or interview will be included. i.e. We make creative and artistic decisions and judgment calls when it comes to lenses, positioning, angles, lighting, etc. and not everyone always agrees on what constitutes a good photograph and sometimes it is a matter of opinion. 9. Liability: All Digital Studios takes the utmost care with respect to exposure, transportation and handling of photos and videos. However, in the unlikely event all of the photos should be lost, stolen, damaged, or destroyed, for reasons beyond our best efforts, our liability is limited to the return of all payments received for photography and video services. If a portion of the wedding images or video is lost for technical reasons, then a refund will directly reflect the direct percentage (portion) of time of the entire event which was lost. i.e. You can?t sue us for possible pain and suffering. 10. Album Selections and Revisions: For packages including an album, it is the responsibility of the contracting party to make image selections within six months of the wedding date. All photo selections must be submitted by January 10 in the year following the wedding date . Videographermakes no guarantee as to how long it will take to finish editing a DVD or constructing an album (although each process generally averages about 8 weeks). The contracting party is entitled to one album revision. Any subsequent revisions will be billed at $100 per hour or $60 per page change. i.e. We like to do albums in the winter off-season months when we can take even more time with them. If you can?t make your selections within 6 months, we are no longer obligated to do an album. 11. DVD Compatibility: Studio makes no guarantee that photo or video DVD?s provided will function in all computers or DVD players. 12. Food: Client will provide Studio reps food & beverage during event. i.e. We aren?t doing this just for the big bucks. We enjoy food too. 13. Overtime: Studio will attempt to ask contracting party for permission for overtime as needed, but it is agreed that overtime charges will be acceptable (as of 1/1/08 at $88 per ½ hour per employee) and can be charged to credit card. i.e. We should be paid if things run late, and 90 percent of the time we get verbal approval from you first. 14. Personnel: Studio employs various professionals and matches up bride with the most compatible professional, but no guarantee is made that any particular, specific person will be at your event. i.e. Requests can be made but not guaranteed. 15. Insurance: We have liability and workman?s comp insurance, but client is responsible if guest damages Studio?s equipment. 16. Digital & Cell Phone Cameras: Client will encourage guests to refrain from standing and taking pictures during ceremony or formals. i.e. You are going to own the digital images and all are posted on line. Distractions from others could diminish the quality of our work. 17. Travel Fees: There are no fees within 45 minutes of our Boulder County location. Past that, fees are $30 per half hour, per employee. 18. Shipping Fees: Albums must be picked up by client at Studio. If not, shipping, handling and insurance fees apply starting at $25. 19. Approval: Album proofs and videos must be approved within 10 days of shipping, otherwise Studio assumes client has approved. 20. Copyrights: Client owns all of the digital images as well.
