VN059 - NOTICE OF CONDITIONAL SETTLEMENT AND VOLUNTARY DISMISSAL. This form is used in the Superior Court of California, County of Ventura, to document and process cases that have reached a settlement before trial. This form notifies the court that the parties have agreed to resolve the matter, and at the request of the plaintiff and/or cross-complainant, the entire action will be dismissed without prejudice. Importantly, the dismissal is considered “conditional” because the court retains jurisdiction under California Code of Civil Procedure section 664.6. This means that even though the case is dismissed, the court has the authority to reopen it and enforce the terms of the settlement if one of the parties defaults on the agreed obligations. The form requires signatures from the plaintiff, defendant, and their attorneys, as well as filing with the court clerk. It must be served on all involved parties with proof of service attached.
