DISPOSITION OF PERSONAL PROPERTY WITHOUT ADMINISTRATION. This form and its accompanying instructions are used in the Fourth Judicial Circuit of Nassau County, Florida, to request the release of a deceased person's personal assets without the need for formal probate proceedings. This simplified legal process is available when the deceased person’s estate consists solely of exempt personal property (such as certain household furnishings or a vehicle) and/or non-exempt property whose total value does not exceed the cost of funeral and final medical expenses. Under Florida law (Section 735.301, Florida Statutes), this type of proceeding allows someone—typically the person who paid for the funeral or medical expenses during the deceased’s final illness—to be reimbursed directly from the limited assets of the estate. To qualify, the deceased must have been a resident of Nassau County, must not have owned non-homestead real property, and the person requesting distribution must have paid qualified expenses out-of-pocket. If unpaid, the funds may be directed to the funeral home or medical provider. The form requires detailed documentation, including the death certificate, proof of payment for expenses, identification of any surviving family or heirs, and confirmation that no other significant assets or debts exist. Once submitted, the Clerk forwards the verified petition to a judge, who determines whether the request meets statutory requirements.
