CR-181 - JURY PROCEDURAL STIPULATION. This form is used by the Superior Court of California, County of El Dorado that outlines and formalizes agreements between the attorneys representing both sides in a jury trial—typically the prosecution or plaintiff and the defense. This form is designed to streamline courtroom procedures and ensure mutual understanding and consent regarding certain jury-related matters. By signing and initialing this form, both parties agree that the jury panel meets the qualifications under California Code of Civil Procedure section 203, and that jurors are considered properly admonished under Penal Code section 1122 at each adjournment or recess, even if the admonition is not restated each time. It also stipulates that the presence of the defendant, counsel, and jurors will be presumed when court resumes unless otherwise noted. Additional provisions include allowing jury instructions and admitted exhibits to be taken into the jury room during deliberations, excusing counsel and the defendant from being present during jury recesses or when the jury is dismissed and reconvened, and permitting the jury to recess or resume deliberations without reassembling in the jury box, provided all jurors are present as determined by the bailiff. The stipulation further allows any judge to receive the jury’s verdict if the trial judge is absent and authorizes the court clerk to swear in an alternate bailiff outside the presence of the judge and parties if needed.
