MOTION TO STAY (DELAY) ORDER FOR SUMMARY EVICTION. This form is used by tenants in the Justice Court, Township of Henderson, Clark County, Nevada, to request the court to delay a summary eviction pursuant to Nevada Revised Statutes (NRS) 70.010 and Justice Court Rules of Civil Procedure (JCRCP) Rule 110. The tenant can request a stay (delay) of an eviction for up to ten days. This means that the eviction will be postponed for the requested number of days, up to a maximum of ten days, depending on the court's decision. The form requires the tenant to explain the reasons for requesting the stay and to declare under penalty of perjury that the information provided is true and correct. The court then reviews the motion and either grants or denies it. If the motion is granted, the court will state how many days the eviction is stayed (delayed) for. If the motion is denied, the eviction process proceeds as originally ordered.
