Description

N.C.G.S. 131F-3(3) EXEMPTION REQUEST FORM. This form is used by charitable or sponsor organizations in North Carolina to request an exemption from the state's charitable solicitation licensing requirements if they have received $50,000 or less in contributions in any calendar year. The form requests various information including the organization's legal name, address, contact details, purpose, fiscal year end month, and whether they compensate officers, trustees, or board members. It also asks if the organization contracts with fundraising consultants or solicitors. If the organization received less than $50,000 in charitable contributions in the preceding fiscal year, they must submit one of the listed financial forms (IRS Forms 990-N, 990 EZ, or 990; a budget approved by the governing board; or the NC Annual Financial Report Form). Additionally, they need to provide a copy of the Federal Tax Exemption Determination Letter if they have one. If applying entity received $50,000 or more in charitable contributions (as defined in N.C. Gen. Stat. § 131F-2(5)) in any calendar year, applicant will NOT qualify for an exemption to the North Carolina charitable solicitation licensing requirements under N.C. Gen. Stat. § 131F-3(3) and must apply for a license.
