ALA ADR-003, NOTICE OF DISCOVERY FACILITATOR SELECTION FORM. In civil litigation, discovery is the process by which parties to a lawsuit obtain information from each other in order to build their case. Discovery can include the exchange of documents, written questions (interrogatories), requests for admission, and depositions. The discovery process can be complex and time-consuming, and sometimes parties may encounter difficulties in obtaining information from each other. To help streamline the discovery process and resolve any disputes that may arise, parties may choose to use a discovery facilitator. A discovery facilitator is a neutral third party who is appointed by the court to assist the parties in resolving disputes related to the discovery process. Once the discovery facilitator has been selected, they will work with the parties to help them resolve any disputes related to the discovery process. The goal is to ensure that the discovery process is conducted efficiently and fairly, ultimately leading to a more effective resolution of the underlying legal dispute. INSTRUCTIONS: Prior to filing this notice, one of the parties or their attorney must contact a discovery facilitator to verify that the facilitator has no conflicts and agrees to facilitate the matter by the discovery facilitation deadline. Parties or their attorneys must identify the case to the facilitator as a Superior Court of California, County of Alameda, Discovery Facilitation Program referral in order to qualify for program rates. All applicable boxes must be completed, and the specified information must be provided.
