Description

B2830 (Form 2830) CHAPTER 13 DEBTOR’S CERTIFICATIONS REGARDING DOMESTIC SUPPORT OBLIGATIONS AND SECTION 522(q). The purpose of the form is to require the debtor to certify that they have met certain requirements under the Bankruptcy Code with respect to domestic support obligations and exemptions. Part I of the form requires the debtor to certify whether or not they owe a domestic support obligation. If they do owe a domestic support obligation, they must also certify that they have paid all such amounts that their Chapter 13 plan required them to pay, as well as any amounts that became due between the filing of their bankruptcy petition and the date of the certification. Part II of the form is only required if the debtor checked the second box in Part I. In this section, the debtor must provide information about their current employer and their employer's address. Part III of the form requires the debtor to certify whether or not they have claimed an exemption pursuant to Section 522(b)(3) and state or local law in property that they or a dependent uses as a residence, claims as a homestead, or acquired as a burial plot. If they have claimed such an exemption, they must also certify that the value of the property does not exceed $189,050 in the aggregate. By signing the form, the debtor certifies that the information provided is true and accurate to the best of their knowledge, and acknowledges that providing false information may result in penalties under the Bankruptcy Code. www.FormsWorkflow.com
