SMCL 017, Small Claims Settlement Agreement, This is a settlement agreement. No judgment will be entered now. The parties agree that the court will dismiss the entire action without prejudice and retain jurisdiction, pursuant to Code of Civil Procedure, section 664.6. This means that either party can come back to court and request enforcement of this agreement. If you do not pay the amount agreed upon as described, a judgment may be entered on the settlement agreement for the unpaid balance. Enforcement must be obtained by filing a Request for Court Order and Answer, (Judicial Council form SC-105) following the procedures as described in California Rules of Court, rule 3.2107.
