CCG 0029 - ORDER FOR REPLEVIN (WITHOUT NOTICE). This form is used in the Circuit Court of Cook County, Illinois. It is issued upon the motion of the plaintiff who seeks to obtain possession of disputed property without providing notice to the defendant. The court makes the following findings: 1. The defendant, who is not a consumer as defined in the relevant act, has voluntarily waived notice and hearing in writing to contest the issuance of the replevin order. 2. Summary seizure without notice is justified based on the necessity to protect the plaintiff from imminent harm, such as destruction, concealment, removal from the state, perishable nature, fraudulent sale or transfer, or theft by the defendant. 3. The plaintiff has established a prima facie case demonstrating a superior right to possession of the disputed property and a likelihood of success on the underlying claim. The order directs the Sheriff of Cook County or another designated officer to seize the specified property belonging to the defendant and deliver it to the plaintiff. The plaintiff must provide a bond of sufficient security in double the value of the property. If the defendant executes a bond in double the value of the property, the seized property shall be returned. The defendant is summoned to answer the plaintiff's complaint by filing an answer or appearance within a specified timeframe.
