AFFIDAVIT OF GARNISHMENT. This is a Georgia Magistrate Court form used by a judgment creditor to begin a garnishment action after obtaining a court judgment. This affidavit is filed against a garnishee, such as an employer or financial institution, who may hold money or property belonging to the judgment debtor. In the affidavit, the plaintiff (or the plaintiff’s attorney or agent) swears under oath that a valid judgment exists, states the court and case number where the judgment was entered, and identifies the amount currently due, including principal, post-judgment interest, and other authorized costs.
