SUPERIOR COURT OF CALIFORNIA, COUNTY OF ORANGE LAMOREAUX JUSTICE CENTER 341 The City Drive South Orange, CA 92868 ­ 3205 PETITIONER: RESPONDENT: CASE NUMBER STIPULATION TO PARTICIPATE IN VOLUNTARY SETTLEMENT CONFERENCE THE PARTIES STIPULATE AND AGREE THAT: The parties will participate in a Voluntary Settlement Conference before a neutral settlement facilitator. The settlement conference may be terminated by any party at any time. The parties understand that this alternative dispute resolution process does not fulfill the mandatory child custody and visitation mediation requirements of Family Code sections 3170 and 3171. The parties understand that the person conducting the Voluntary Settlement Conference is not a court connected mediator, but is a volunteer. The settlement facilitator represents that he/she has no personal or financial interest in the outcome of the Voluntary Settlement Conference. The settlement facilitator does not act as an advocate, representative, fiduciary, lawyer, or therapist for any party, and does not have any authority to impose a decision on the parties. Statements made during the Voluntary Settlement Conference are considered confidential and may not be used in court in the event an agreement is not reached. No record shall be made except to memorialize a settlement. Offers to settle or compromise, statements, admissions, and all related negotiations during the Voluntary Settlement Conference are to be considered confidential and privileged and are inadmissible to prove the validity or invalidity of any party's claim pursuant to Evidence Code section 1152. Confidentiality, however, will not extend to crimes, threats of imminent physical harm, or acts of actual violence occurring during the settlement conference. In situations where there is a reasonable suspicion that elder abuse or child abuse and/or neglect has occurred, the settlement facilitator may report such suspicion. The parties agree that the provisions of Evidence Code section 703.5 shall apply to the settlement conference. By signing below, each party acknowledges that he or she has been given a copy of this agreement and has read and understands it.
