406.5 Malice One acts maliciously in [instituting] [continuing] a [criminal] [civil] proceeding against another if he does so for the primary purpose of injuring the other, or recklessly and without regard for whether the proceeding is justified, or for any primary purpose except [to bring an offender to justice] [to establish what he considers to be a meritorious claim].
