160.09 FELA--No Assumption of Risk by Employee At the time of the occurrence there was in force a federal statute which provided that in any action brought against a railroad to recover damages for [injury to] [death of] an employee, the employee shall not be held to have assumed the risks of his employment in any case where the [injury] [death] resulted in whole or in part from the negligence of any of the officers, agents or employees of the railroad, [or by reason of any defect, due to the railroad's negligence, in its [cars,] [engines,] [machinery,] [track,] [roadbed,] [works,] [boats,] [wharves,] [or] [other equipment]].
