78.010 Year's Support; Entitlement The surviving spouse and minor children of a testate or intestate decedent are entitled to a year's support in the form of property for their support and maintenance for the period of twelve months from the date of the decedent's death. As used herein, the terms "child" or "children" mean any minor child who would be entitled to inherit if the child's parent died intestate. It is now up to you to decide what money and property of the estate, if any, is to be awarded as a year's support. O.C.G.A. §53-3-1(a), (c)
